To comply with the Telephone Consumer Protection Act (TCPA) as well as the Formstack Software Services Agreement and Formstack SMS Terms of Service, Formstack requires that senders obtain from SMS recipients their express consent to receive SMS text messages from Formstack. This consent should be collected directly from SMS recipients before sending envelopes by SMS delivery. This consent precedes and is in addition to the consent the SMS recipient provides when they receive the SMS notification.
Tips on how to collect an SMS recipient consent for a SMS message
As a SMS sender, you must collect verbal consent from a SMS recipient through email, phone or in person communication. The following is sample script that you may use to obtain consent:
